Houma business sues two Louisiana companies, alleging failure of coverage

A Houma company is suing its contractor and insurance company, alleging they are obligated to provide more defense and coverage related to claims filed in a separate lawsuit.

Manson Gulf filed a civil action lawsuit Aug. 18 in U.S. District Court Eastern District of Louisiana against Modern American Recycling Service (MARS) Inc. and the Gray Insurance Company, alleging breach of contract.

According to the complaint, on July 27, Angie G. LaFleur filed for damages in Terrebonne Parish state court arising from the June 16 death of James LaFleur at a Gibson MARS facility, with Manson Gulf as a MARS subcontractor at the time.

The suit says Manson Gulf denies any liability with respect to the claim, and in addition, as outlined in a marine master work contract between Manson Gulf and MARS, MARS is obligated to defend, hold harmless, and indemnify Manson Gulf from the LaFleur claims.

The lawsuit also states Gray Insurance owes additional insured coverage to Manson Gulf against LaFleur's claims. Both defendants have failed to comply with their contractual obligations to Manson Gulf, according to the suit.

Manson Gulf seeks a judgment compelling the defendants to provide defense, indemnity, and insurance coverage to Manson Gulf, plus attorney fees and court costs.
