Progressive Waste Solutions sued by a woman who claims she broke her hip after closing her garbage bin

GRETNA – A local waste management company is being sued by a woman who claims she was injured in the process of closing her trash bin when she was thrown to the ground and broke her hip.

Myrtle Armstrong filed suit against Progressive Waste Solutions of LA Inc. and the Parish of Jefferson through its duly elected president John F. Young Jr. in the 24th Judicial District Court on July 10.

Armstrong contends she was using a garbage bin provided by Progressive Waste Solutions of LA Inc. through Jefferson Parish for the first time when the lid of the trash can fell backwards and as she tried to catch it she fell to the ground. The plaintiff asserts she was severely injured and broke her hip in the incident.

The defendant is accused of negligence including supplying a large and unwieldy garbage bin.

An unspecified amount in damages is sought by the plaintiff.

Armstrong is represented by Raymond A. Pelleteri Jr. of New Orleans-based Pelleteri & Wiedorn LLC.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
