GRETNA – The driver of a dump truck and its owner are being sued by a motorist who claims her car was stuck by unsecured rocks and gravel in the back of the truck causing her to swerve and have an accident.

Bernadette Morris filed suit against Curtis W. Hinson, Curtis Services LLC and Scottsdale Insurance Company in the 24th Judicial District Court on July 10.

Morris asserts on July 11, 2014 she was driving a 2002 Honda Accord on the Westbank Expressway where Hinson,  as an employee of Curtis Services , was operating a 1994 Ford L9000 Dump Truck when rocks, gravel and debris flew out of the truck's bed and into her car. The plaintiff claims the incident caused her to swerve and suffer property damage and disabling injuries.

The defendant is accused of failing to exercise reasonable care, not seeing what should have been seen, operating a vehicle in a careless manner and failing to maintain reasonable and proper control.

An unspecified amount in damages is sought for medical expenses, medical expenses, physical pain and suffering, mental pain and anguish, permanent disability and property damage.

Morris is represented by attorney Preston G. Sutherland of New Orleans.

The case has been assigned to Division C Judge June Berry Darensburg.
