Contractor sued over allegedly faulty roof replacement

NEW ORLEANS – A property insurer for a condominium association is suing a  contractor for allegedly faulty roof replacement.

Everest Indemnity Insurance Company filed suit against Lanaux Construction Company and Colony Insurance Company in the Orleans Parish District Court on July 2.

Everest Indemnity Insurance Company claims Lanaux Construction was negligent in its roof replacement of Stella Maris Condominiums and owes money for damages caused by rainwater.

The plaintiff alleges that around July 7, 2014, a large amount of rainwater entered one or more condominium units and caused extensive damage. The rainwater allegedly entered through an area of the roof being replaced by Lanaux Construction. The plaintiff claims they paid for the damages amounting to $44,158,58 after Stella Maris Condominiums filed a "proof of loss" claim. Everest Indemnity is now seeking repayment of that amount because it holds that Lanaux Construction’s work was performed poorly and did not conform to the applicable contracts and warranties.

The defendant is accused of breach of contract.

Damages in the amount of $44,158.58 are being sought as well as the $5,000 deductible and all legal and attorney fees.

Everest Indemnity Insurance Company is represented by Andre J. Mouledoux.

The case has been assigned to Judge Regina H. Woods

Case no. 2015-06386.
