A New Orleans man is suing his former employer, alleging violations to the Americans with Disabilities Act (ADA) and the Fair Housing Act.

Dustin Jacobson filed a lawsuit Oct. 8 in U.S. District Court for the Eastern District of Louisiana against Hobnobber’s Variety Bar, Inc., Paul Timphony, Cheryl Timphony, ABC, and XYZ, alleging violations of the ADA and Fair Housing Act in regards to the plaintiff being HIV-positive.

According to the complaint, Jacobson worked for the defendants and lived in an apartment leased from Hobnobber’s. His ex-girlfriend alerted the defendants that Jacobson had contracted the HIV virus, and on Oct. 31, 2014, the suit says, his employment with the bar was terminated and he was evicted.

The plaintiff alleges Hobnobber's fired and evicted him only because of his disability.

Jacobson seeks a declaration from the defendants they violated his rights, an injunction against future violations, unspecified damages, litigation costs and other relief deemed appropriate by the court. He is represented by attorneys Galen M. Hair and Alejandro J. Rodriguez of Varadi, Hair & Checki in New Orleans.
