Louisiana companies allege Broadway Insurance has not provided coverage

The owners of two Louisiana companies are suing an insurance agency, alleging lack of coverage.

Tom's Marine and Salvage of Lafitte and Tom's Welding of Buras filed a lawsuit Oct. 30 in U.S. District Court Eastern District of Louisiana against Broadway Insurance Agency and John Uhr, a one-time broker and agent of Broadway.

Since 2011, the complaint states, the plaintiffs had contracted with the defendant for insurance coverage for their businesses, including worker's compensation, general liability, marine liability for their vessels, automobile liability and umbrella liability.

Until the end of 2014, the suit says, Uhr offered to obtain insurance for the plaintiffs and they accepted. However, the plaintiffs discovered even though they had paid more than $40,000 annually for coverage, that money was never sent to insurance company, the suit says. In the meantime, the plaintiffs have had claims to pay but were unable to do so, the suit says, because no insurance policies were in place.

The plaintiffs seek judgment against the defendants for all damages resulting from their actual lack of insurance, a jury trial, plus interest, court costs and attorney fees. They are represented by attorneys Timothy DePaula, John Musser and Tarryn Walsh of Murphy, Rogers, Sloss, Gambel & Tompkins in New Orleans.
