Car buyer alleges Volkswagen committed fraud

A New Orleans car buyer is suing Volkswagen, alleging it falsified environmental claims.

Byron Jeanice filed a lawsuit, on behalf of himself and others similarly situated, Sept. 25 in U.S. District Court Eastern District of Louisiana against Volkswagen Group of America, alleging fraud.

The plaintiff purchased a Volkswagen Jetta TDI in 2009 and he still owns the vehicle. According to the complaint, because Volkswagen admitted earlier this year that it installed devices in its diesel vehicles to reduce the effectiveness of emissions control systems, thereby making them appear to do less damage to the environment, the Jeanice is suing the company and seeks others to join in the class action.

Jeanice seeks temporary and permanent injunctions to prevent Volkswagen from continuing the unlawful, deceptive, fraudulent and unfair business practices of which it is accused, either a recall or free replacement program, a judgment against the defendant for costs, restitution and damages, plus attorney fees and court costs. He is represented by attorneys Scott R. Bickford, Lawrence J. Centola, Neil F. Nazareth and Jason Z. Landry of  Martzell & Bickford in New Orleans.
