NEW ORLEANS – A Louisiana couple say the new Dodge Ram truck they purchased from Acadiana Dodge was defective in materials and workmanship and are asking to return the truck for a refund.

Christopher and Susie Touchet filed a lawsuit Nov. 17 in U.S. District Court for the Eastern District of Louisiana against FCA US, Acadiana Dodge Inc. and Americredit Financial Services Inc., citing violations of the Louisiana Redhibition Laws, lender liability, violation of the Magnuson-Moss Warranty Act and negligent repair.

According to the complaint, the 2014 Dodge Ram 1500 truck the Touchets bought on Feb. 8 from Acadiana was in for repairs several times, keeping them from using it for weeks at a time. The suit says the dealer's failed attempts at repair violate the implied and express warranties they issued to the buyers at the time of purchase.

The Touchets seek rescission of the sales contract, a jury trial and damages of more than $50,000, plus litigation costs. They are represented by attorney Richard C. Dalton of Mandeville.
