Two transportation firms head to court in dispute over freight deal

NEW ORLEANS – A transportation company is suing New Orleans Trucking for alleged breach of contract.

C&H Trucking Inc. filed a lawsuit Nov. 3 in the U.S. District Court for the Eastern District of Pennsylvania against New Orleans Trucking and Rental Depot Inc., citing breach of contract.

From December 2007 and continuing through 2012, the two companies partnered for brokered transportation services for third-party shippers under several different contracts, the complaint states.

According to the complaint, C&H was entitled to 70 percent of the revenue and 100 percent of the fuel surcharges collected by New Orleans Trucking. However, the suit says that in violation of the agreement, freight bills proving the payment amounts were not delivered.

C&H Trucking seeks documentation proving they were adequately paid under the original contract, litigation costs and other damages approved by the court. They are represented by Metairie attorney Claudia P. Santoyo.
