Handicapped man accuses Housing Authority of violating disabilities law

NEW ORLEANS – An Orleans Parish man, wheelchair-bound with spinal injuries, says the Housing Authority of Jefferson Parish refused to reschedule a deadline, denying him Section 8 housing.

Francis Falls filed a lawsuit Dec. 4 in the U.S. District Court for the Eastern District of Louisiana against the Housing Authority of Jefferson Parish and its chief executive, Juan Patterson, as well as the Louisiana Housing Development Corp., alleging violations of the Americans with Disabilities Act.

According to the complaint, Falls had been on a waiting list for Section 8 housing for two or three years when he received a request for eight different pieces of documentation no later than the next day, Nov. 12. Since the deadline conflicted with a doctor’s appointment, the suit claims Falls requested an extension, but was denied. Thereafter, he claims his name was stricken from the waiting list completely.

Falls seeks compensatory and punitive damages, injunctive and declaratory relief, and litigation costs. He is represented by attorneys Andrew D. Bizer, Garret S. DeReus and Amanda K. Klevorn of The Bizer Law Firm in New Orleans.
