NEW ORLEANS – An Arkansas mother is suing a drug corporation in relation to her son's medical conditions, alleging that a drug she was prescribed during her pregnancy caused the congenital defects.
Jody Huffmaster filed a complaint on Sept. 14 in the U.S. District Court for the Eastern District of Louisiana against GlaxoSmithKline LLC alleging strict liability, deceptive and unconscionable trade practices, design defect, breach of express/implied warranty and other counts.
According the complaint, Huffmaster was prescribed prescription drug Zofran while she was pregnant with her son. She was informed that the drug would be helpful in the treatment of morning sickness. As a result of taking Zofran, Huffmaster claims, her son was born in 2007 with multiple serious conditions, such as cleft palate and respiratory distress syndrome, which will negatively impact the remainder of his life. Huffmaster is suing for the defects in the medication and the negligence in failing to notify her of the medicine's risks.
Huffmaster is seeking compensation for damages suffered and all legal fees. She is represented by James R. Dugan II of The Dugan Law Firm APLC in New Orleans.
