NEW ORLEANS – A Georgia company is seeking a temporary restraining order and an ex parte seizure order in connection with a lawsuit against a former employee the company claims illegally took confidential company files.
Brand Services LLC filed a complaint on Aug. 11 in the U.S. District Court for the Eastern District of Louisiana against James Stanich, alleging violation of the Computer Fraud and Abuse Act, conversion and breach of contract.
According to the complaint, Stanich was employed by the defendant as an IT specialist and was trusted with confidential information. During his employment, Stanich agreed to honor all confidential information and it was agreed that he would not disclose any information in the event of his leaving the company. After Stanich voluntarily resigned in June, however, it was discovered that he had transferred confidential files to an external hard drive from a company laptop. Brand Services is suing the defendant for violation of his non-compete contract.
Brand Services is seeking compensation and restitution of all violations committed by Stanich, preliminary injunction, the return of all information allegedly taken by Stanich, as well as all legal fees incurred. The company is represented by Elvige Cassard of Ogletree, Deakins, Nash, Smoak and Stewart PC in New Orleans.
