Driver accuses Bankers Standard Insurance of failing to pay claim

NEW ORLEANS – A New Orleans Parish woman says her auto insurance company is dragging its feet in paying her claim for damages caused by an underinsured motorist.

Emily Gerra filed a lawsuit Dec. 30 in U.S. District Court for the Eastern District of Louisiana against Bankers Standard Insurance Co., alleging failure to resolve a valid personal injury claim.

According to the complaint, Gerra was approaching the intersection of North Hagan and Toulouse streets on Jan. 5, 2015, when she was struck by another driver, Jose Chirinos, who was going the wrong way. Chirinos, who had no driver's license, was an underinsured motorist, according to the suit, and was wholly at fault for the accident.

Gerra, who sustained neck, head and back injuries and associated medical expenses, claims Bankers Standard has failed to adjust her claim promptly and has delayed compensation, despite providing them with proof of loss.

Gerra seeks compensatory damages and legal fees. She is represented by attorneys Vincent J. Glorioso III and Vincent J. Glorioso Jr. of The Glorioso Law Firm in Metairie.
