NEW ORLEANS – International bank ING is suing a Chinese firm over allegedly unpaid marine bunker deliveries to its boats.

ING Bank N.V. filed a lawsuit Jan. 4 in U.S. District Court for the Eastern District of Louisiana against Fujian Ocean Shipping Co. LTD (FOSCO), alleging breach of contract.

According to the complaint, ING Bank is a creditor for two companies, O.W. Bunker Far East LTD and Dynamic Oil Trading LTD, that FOSCO allegedly owes money for marine bunkers it purchased for several vessels. As Bunker and Dynamic Oil are claimed to be in default in a revolving credit agreement with ING, the suit says the bank is seeking payment for the shipment on behalf of its borrowers. The amount in question is $3,422,604.94, the complaint states.

ING Bank seeks the arrest and sale of the marine vessel Zheng Yao, a boat owned by FOSCO, and any of FOSCO’s other property in Louisiana to cover the unpaid amount. It is represented by attorneys James D. Bercaw, Robert J. Stefani, Len R. Brignac and Laura E. Avery of King, Krebs & Jurgens PLLC in New Orleans.
