NEW ORLEANS – A seaman alleges that his employers failed to maintain a proper and safe working environment.

Dwayne P. Dickerson filed a lawsuit Jan. 29 in the U.S. District Court for the Eastern District of Louisiana against Fieldwood Energy LLC and All Coast LLC over allegations that the defendants were negligent and failed to provide a reasonably safe place to work.

Dickerson alleges that on or about July 24, he was employed by Fieldwood Energy as a Jones Act Seaman about the vessel Swordfish, which was owned, operated and/or controlled by All Coast LLC, when he suffered a severe accident that injured his knees and other parts of his body. Dickerson alleges that the defendants breached the legally imposed duty of reasonable care owed to him, failed to provide a reasonably safe place to work, failed to properly supervise or train him, failed to take precaution and any provisions for the safety of crew, created and maintained an unseaworthy vessel, and other acts of negligence. As a result of alleged negligence of the defendants, Dickerson has suffered physical, mental and emotional pain, past and future disability, lost wages and medical expenses, he claims.

He is suing for payment of past, present, and future adequate maintenance benefits; punitive damages; wages; attorneys' costs; and for all general and equitable relief.
