NEW ORLEANS – The owners of Barataria Plaza Shopping Center and Rum Runner are being taken to court over alleged accessibility problems.
Lawrence Fultz filed a suit on Feb. 12 in the U.S. District Court for the Eastern District Louisiana against Rum Runner Café LLC, Chan W. Kang and Myong L. Kang claiming that the defendants have not complied with Americans with Disabilities Act (ADA) regulations.
Fultz alleges that Rum Runner and Barataria Plaza Shopping Center, located at 1670 Barataria Blvd. in Marrero, have made it difficult for people with mobility disability from accessing the property. Fultz claims that he has visited the Barataria and Rum Runner numerous times and desires to visit the premises again in the near future for Rum Runner’s Tuesdays and Thursdays daiquiri drink specials. However, certain physical barriers have made such visits difficult for him, the suit states. Such barriers allegedly include a built-up curb ramp, no vertical signage in accessible-designated parking spaces, a cross slope on the promenade, insufficient knee clearance in the restroom stalls, a paper towel dispenser is located too high, no grab bars in restroom stalls and no accessible route to the public sidewalk.
Therefore, he is asking the court to order the defendants to alter the property to make it accessible for individuals with disabilities as required by the ADA, cost of suit, attorney fees, and any other reward deemed proper by the court.
