Gulf South Quality Network – New Orleans accused of breach of contract

NEW ORLEANS – A medical technology company is seeking damages after it claims a Metairie business breached their contract.

Medecision Inc. filed a lawsuit on Feb. 26 in the U.S. District Court for the Eastern District of Louisiana against Gulf South Quality Network – New Orleans LLC (GSQN), citing breach of contract.

The plaintiff alleges that it is a company that provides technology-based solutions to clients in the health care industry. One of its alleged services is providing subscription access to its proprietary health management software. On Dec. 1, 2014, the plaintiff executed an agreement with the defendant to provide certain technology solutions and services, which includes access to plaintiff’s software and tech and business support in exchange for a monthly service fee.

Both parties allegedly agreed that Medecision would hold the right to discontinue services if GSQN withheld payments for any reason, that GQSN is contractually bound to pay Medecision’s invoice in a timely manner even if there is a dispute, and that any late payment by GQSN would entitle Medecision to recover any cost of collection and GQSN shall be charged a rate of 1.5 percent per month until late payment is paid in full. The plaintiff asserts that GQSN has not paid its fee totaling $836,576.59 despite attempts by plaintiff to request payments.

Medecision is now suing for damages in the amount of $836,576.59 plus the cost of collection, including attorneys' fees and interest, and for any other relief deemed just by the court. The company is represented by Covert J. Geary, Andrew R. Lee and Joseph C. Davis from Jones Walker LLP in New Orleans.
