Man alleges his hip implant is faulty, caused damages

LAFAYETTE – A man is suing Stryker Orthopaedics over allegations that its hip implant system resulted in revision surgery, pain and a concentration of heavy metals in his body.

Michael Perry filed a lawsuit on Feb. 25 in the U.S. District Court for the Western District of Louisiana against Howmedica Osteonics Corp., doing business as Stryker Orthopaedics, citing negligence, products liability, breach of warranties, and consumer fraud under federal and state law.

According to the complaint, Perry underwent a surgical implant operation to his left hip on March 23, 2013, in the Parish of Lafayette at Lafayette Surgical Specialty Hospital. Since the surgery, the plaintiff claims to have suffered a myriad problems, including lab results that indicated his body contained chromium and creatinine particles.

The suit states that the damages to the plaintiff's body resulted from the Stryker Trident Acetabular System Hip Implant, which the defendant manufactured. The hip implant was approved and began medical circulation in 2003 before the FDA allegedly issued warnings against the product in 2007.

The plaintiff claims that the hip implant caused pain to his left hip joint after surgery, which was compounded with the lab results showing the presence of heavy metals. Perry states that he will have to undergo revision surgery for the removal of the hip replacement system.

Perry seeks compensatory damages, punitive damages, pre- and post-judgment interest, costs and expenses, medical monitoring, attorneys’ fees and a trial by jury. He is represented by Burton P. Guidry of Burton P. Guidry and Associates in Abbeville.
