NEW ORLEANS – A former employee of Check-6 Inc. is collectively suing the company over allegations of unpaid overtime compensation.

Joseph Goodly, on behalf of himself and all others similarly situated, filed a class-action lawsuit on March 7 in the U.S. District Court for the Eastern District of Louisiana against Check-6 Inc., Yarema Sos, Brian Brurud, Dennis Romano, S. Eric Benson, Laura Owen and John Dillon, citing violations of the Fair Labor Standards Act.

According to the complaint, Goodly was employed by the defendant as a coach from August 2014 through August 2015. The plaintiff alleges that he and other employees were paid a day rate with no overtime pay for hours worked over 40 in a workweek. Goodly avers that the defendants were engaged in a pattern of willfully violating the FLSA by failing to pay the day rate and overtime compensation.

Goodly seeks a collective action designation, an award of all damages for unpaid wages, liquidated damages, pre- and/or post-judgment interest, attorneys’ fees, costs and a trial by jury.
