LAFAYETTE — Two former employees are suing a Carencro home retail stores, alleging unpaid minimum wage and overtime compensation.

Destin Ray Marks and Millie Kay Bouget filed a lawsuit, individually and on behalf of others similarly situated, March 17 in U.S. District Court for the Western District of Louisiana against Andries and Associates LLC, doing business as Evangeline Home Center, alleging violations of the Fair Labor Standards Act (FLSA)

According to the complaint, Marks was hired in 2011 as a “salesperson” by the defendant and remained in that position until September 2015. Similarly, Bouget was hired in 2013 as a “salesperson” and remained in her position until July 2015.

The plaintiffs allege they were paid outright commission equal to amounts ranging from 10 percent to 25 percent and worked an average of 48 hours per week. They argue that in weeks in which their commission did not meet or exceed the requirements of the FLSA, they were not paid minimum wage or compensated for overtime work. The suit states the defendant employs more than 50 people who are paid in a similar manner.

Marks and Bouget seeks past and future overtime wages, past and future minimum wage rate, liquidated damages, attorney fees and a trial by jury. They are represented by attorney Kenneth D. St. Pe of Lafayette.
