Couple sues Chuck E. Cheese's for allegedly not accommodating son's food allergies

LAFAYETTE – A couple is suing the owners of a Chuck E. Cheese's for allegedly failing to accommodate for their son’s allergies.

Christin Hebert and Corey Hebert, on behalf of a minor, B.H., filed a lawsuit on March 22 in the U.S. District Court for the Western District of Louisiana against CEC Entertainment Inc., citing violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff’s son suffers from a medically diagnosed food allergy, putting him at risk to an anaphylactic allergic reaction if he comes in contact with dairy products. On Nov. 29, 2015, the plaintiffs claim they took their son to a Chuck E. Cheese restaurant owned by the defendant and asked for the restaurant to make accommodations for their son’s allergy.

The manager allegedly told the plaintiffs that their son would be able to eat chicken nuggets served at the establishment, but upon looking at the menu, the Heberts found that the chicken nuggets contained dairy. They aver that the defendant discriminated against their son for the oversight and for not being allowed to bring in outside food to adequately accommodate his allergy, when he had been allowed to do so on prior occasions.

The Heberts seeks an order enjoining the defendant from prohibiting individuals with allergies from bringing outside food into the establishment, attorney’s fees and costs. They are represented by Andrew D. Bizer, Garret S. Dereus, and Amanda K. Klavern of The Bizer Law Firm in New Orleans.
