NEW ORLEANS — A Covington restaurant owner is suing Capital One, alleging failure to comply with a court order.
Kanetha Arun Chau filed a lawsuit Feb. 4, in U.S. District Court for the Eastern District of Louisiana against Capital One NA alleging the national bank violated the bankruptcy code by placing her accounts on internal freeze or hold.
According to the complaint, Chau had to stop operations of her restaurant businesses, Pho An and Thai Chili, both in Covington, resulting from non-payment of payroll obligations and supplies to continue operations. The plaintiff alleges the defendant failed to send notification or proof of a court order authorizing a hold and freeze order on her accounts and refused to unfreeze and surrender the funds in her accounts.
Both restaurants closed Aug. 9, 2015, the suit says.
Chau seeks a trial by jury and compensation for damages regarding equitable relief and for all other relief the court may grant. She is represented by attorney Phillip K. Wallace of Mandeville.
