U..S government alleges Houma woman falsely claimed Social Security

NEW ORLEANS — The U.S. government is suing a Houma woman, alleging negligent misrepresentation.

The United States of America, on behalf of the Social Security Administration filed a lawsuit Feb. 16, in U.S. District Court for the Eastern District of Louisiana against Andrea Charles of Houma, alleging she failed to promptly notify the Social Security Administration of any change in her medical condition or work capability.

According to the complaint, the government suffered damages due to overpayment of disability benefits. The plaintiff alleges Charles engaged in substantial gainful activity while receiving disability benefits, received disability benefits to which she was not entitled and amassed an overpayment debt to the SSA of $52,678.59.

The U.S. government seeks trial by jury, judgment denying Charles a discharge of her debt to SSA and for other relief the court deems appropriate. It is represented by attorneys Glenn K. Schreiber of the U.S. District Court Eastern District of Louisiana in New Orleans, and Michael McGaughran and Henry Ernest Velte III of the Office of the General Counsel Social Security Administration in Dallas.
