Bank seeks repayment of allegedly unpaid auto loan

BATON ROUGE – A bank alleges that a woman purchased a car using a loan and did not make payments under claims that the vehicle purchase was fraudulent.

Fifth Third Bank filed a complaint on Feb. 1 in the U.S. Bankruptcy Court for the Middle District of Louisiana against Cheryl Brown alleging that the vehicle owner has defaulted on her payment for the purchase of 2011 Jaguar XJ8.

According to the complaint, the plaintiff alleges that it suffered damages in the amount of $63,020.91. The plaintiff holds Brown responsible because the defendant allegedly subleased the vehicle to a third party, listed that her debt owed to plaintiff as fraud, denied having purchased the vehicle and filed a voluntary petition for relief under the Bankruptcy Code.

The plaintiff requests a trial by jury and seeks judgment determining that the debt is not dischargeable, a judgment against defendant in the amount of $63,020.91, plus interest, attorneys' fees and costs and any further relief that is just. It is represented by Gregory J. Walsh, Earl F. Sundmaker and Arthur S. Mann III of The Sundmaker Firm LLC in New Orleans.
