ALEXANDRIA — A bank is suing a Louisiana woman, alleging false representations and actual fraud.

Simmesport State Bank filed a lawsuit March 11 in U.S. Bankruptcy Court for the Western District of Louisiana Alexandria Division against Darlene Marie Lemoine of Moureauville, alleging the defendant violated bankruptcy law.

According to the complaint, Simmesport State Banks sustained losses and damages of $4,752.62. The plaintiff alleges Lemoine applied for an unsecured loan within 90 days before filing her voluntary petition for relief and made an implied representation of her intent to repay the debt in accordance with the terms and conditions of the agreement. 

The suit says the defendant failed to make any payments, evidencing her intention and knowledge of her inability to repay the loan.

Simmesport State Banks seeks a trial by jury, a judgment of $4,752.62 that is nondischargeable, attorney fees, costs, interest and any further relief the court deems appropriate. It is represented by attorney Chantel K. Adams of Kizer, Hood & Morgan, LLP in Baton Rouge.
