Lafaeytte Parish business alleges Louisiana man owes $65,000

NEW ORLEANS — A Lafayette Parish company is suing a Louisiana man, alleging false representation or actual fraud.

Butcher Distributors LLC filed a complaint April 4, in U.S. Bankruptcy Court for the Eastern District of Louisiana against Rogelio Satiro Timoteo alleging he failed to comply with their joint payment agreement with Vista Contractors.

According to the complaint, Butcher sustained a loss of goods and/or payments of $65,097.60. The plaintiff alleges Timoteo responsible because he personally guaranteed the payment of the debt of Vista Contractors. As a guarantor, he failed and refused to honor the debt and remit payment, the suit says. 

The defendant sought bankruptcy relief two months after the plaintiff filed a suit with the 15th Judicial District Court for the Parish of Lafayette.

Butcher Distributors seeks a trial by jury, the defendant's debt of $65,097.60, plus interest is non-dischargeable funds, attorney fees and costs, plus any relief the court deems appropriate. It is represented by attorney Jeffrey A. Riggs of Lewis Brisbois Bisgaard & Smith LLP in Lafayette.
