NEW ORLEANS – A general construction laborer has filed a class-action lawsuit against his employers over allegations they did not pay employees overtime wages.
Jose Castellanos filed a complaint on behalf of other persons similarly situated on March 28 in the U.S. District Court for the Eastern District of Louisiana against
Saints & Santos Construction LLC, Wiliomar Oliveira and Jose Santamaria
alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he did not receive proper overtime compensation. The plaintiff holds Saints & Santos Construction LLC, Oliveira and Santamaria responsible because the defendants allegedly failed to pay him one-and-half times his hourly rate for all hours worked in excess of 40 in a work week in violation of federal law.
The plaintiff requests a trial by jury and seeks a declaration that the defendants’ conduct violated the FLSA, enjoining defendants from violating the FLSA, compensation for unpaid wages, liquidated damages, attorneys’ fees, costs and interest and such other equitable relief as the court deems equitable and just. He is represented by Roberto Luis Costales of Costales Law Office in New Orleans and William H. Beaumont in New Orleans.
