Receptionist alleges employers failed to pay overtime, violated Family Leave Act

LAFAYETTE — A receptionist is suing her employers, alleging they failed to pay overtime and discriminated against her for being pregnant. 

Kathleen Maloy of Desoto Parish filed a lawsuit April 5 in U.S. District Court for the Western District of Louisiana against S3 Power Sports LLC, Malcolm H, Sneed III, Linda Sneed, Courtney Sneed, Nichole Sneed Scates and Dustin Jones, alleging they violated the Fair Labor Standards Act and the Family and Medical Leave Act.

According to the complaint, Maloy regularly worked more than 40 hours per week, including on her lunch break, without proper overtime compensation during her entire employment. The suit says she was unfairly criticized for work she did not get done while she was on her approved days off. The lawsuit states she was encouraged to get more work done and come in earlier. 

The plaintiff alleges the defendants failed to properly compensate her overtime at 1 1/2 of her hourly rate for all her extra hours worked, discriminated against her and then terminated her employment Dec. 11, 2015, because of her sex, pregnancy and pregnancy-related disabilities.

Maloy seeks a trial by jury, compensation for unpaid wages, plus interest, liquidated damages, attorney fees, legal costs and other relief to which she is entitled under law. She is represented by Alan Kansas of The Law Office of Alan Kansas LLC in Terrytown.
