NEW ORLEANS — An Illinois man is suing a group of pharmaceutical companies, alleging a defective warranty and design.

Clarence Harbauer filed a lawsuit April 4, in U.S. District Court for the Eastern District of Louisiana against Jansen Research & Development LLC, Jansen Ortho LLL, Jansen Pharmaceuticals Inc., Johnson & Johnson Company, Bayer Pharma AG, Bayer Corporation, Bayer Healthcare Pharmaceuticals Inc., Bayer Healthcare AG and Bayer AG,  alleging they violated consumer protection laws and the consumer fraud laws.

According to the complaint, on April 15, 2015, Harbauer was admitted to a hospital for treatment for suffering a life-threatening, irreversible bleeding from the use of Xarelto. The suit says the plaintiff suffered serious and dangerous side effects including life-threatening bleeding as well as other severe and personal injuries that are permanent in nature. 

The plaintiff alleges the defendants failed to properly investigate, research, study and define the safety profile of Xarelto, failed to adequately test Xarelto, failed to provide adequate warnings, failed to disclose the need for dose adjustments, failed to provide adequate instructions and concealed their knowledge of Xarelto’s defects.

Harbauer seeks a trial by jury and compensation for economic, punitive and/or exemplary damages, pre-judgment and post-judgment interest, reasonable attorney fees and costs, plus other relief as the court deems and proper.
