NEW ORLEANS – A Pennsylvania man alleges he suffered injuries after taking a prescription drug.

David Blair filed a complaint on April 8 in the U.S. District Court for the Eastern District of Louisiana against Jansen Research & Development LLC, Jansen Ortho LLL, Jansen Pharmaceuticals Inc., Johnson & Johnson Co., Bayer Pharma AG, Bayer Corp., Bayer Healthcare Pharmaceuticals Inc., Bayer Healthcare LLC, Bayer Healthcare AG and Bayer AG citing alleged fraud, design defect, manufacturing defect, failure to warn, breach of express and implied warranty and negligent misrepresentation.

According to the complaint, the plaintiff alleges that on or about February 7, 2014, he began using Xarelto after a consultation with his physician and on approximately April 8, 2014, he suffered gastrointestinal bleeding, rectal bleeding and anemia and was hospitalized. He alleges this gastrointestinal bleeding caused him pain and suffering, permanent injury, mental anguish, diminished enjoyment of life and financial expenses for hospitalization and medical care.

The plaintiff holds the defendants responsible because the defendants allegedly designed, researched, manufactured, tested, advertised, promoted, marketed distributed and sold Xarelto. They allegedly also failed to properly investigate, research, study and define, fully and adequately, the safety profile of Xarelto; failed to adequately test Xarelto; failed to provide adequate warnings; failed to disclose the need for dose adjustments; failed to provide adequate instructions; and failed to warn the medical professionals that there is no effective agent to reverse the effects of Xarelto.

The plaintiff requests a trial by jury and seeks compensation for damages, including but not limited to past, present and future economic expenditures; past and future medical expenses, punitive damages, attorneys’ fees, costs, post-judgment interest and such other relief as the court may deem appropriate.
