NEW ORLEANS – A New Jersey woman has filed suit against several pharmaceutical companies alleging a prescription drug caused bleeding.

Inez Schearer filed a complaint on April 13 in the U.S. District Court for the Eastern District of Louisiana against Janssen Research & Development LLC, Janssen Ortho LLC, Janssen Pharmaceuticals Inc., Bayer Healthcare Pharmaceuticals Inc., Bayer Pharma AG, Bayer Corp., et al. citing strict liability, manufacturing defect and other counts.

According to the complaint, the plaintiff alleges that from April 20, 2013, to April 19, 2014, she ingested Xarelto and suffered severe adverse bleeding on April 19, 2014. As a direct and proximate result of his use of Xarelto, she alleges she also suffered serious and dangerous side effects, including but not limited to adverse bleeding, severe and personal injuries which are permanent and lasting in nature.

The plaintiff holds the defendants responsible because the defendants allegedly designed, researched, manufactured, tested, advertised, promoted, marketed, distributed and sold Xarelto. They also allegedly failed to properly investigate, research, study and define, fully and adequately, the safety profile of Xarelto; failed to adequately test Xarelto; failed to provide adequate warnings; failed to disclose the need for dose adjustments; failed to disclose the need to twice daily dosing; and failed to provide adequate instructions.

The plaintiff requests a trial by jury and seeks compensation for all economic and non-economic damages, punitive and/or exemplary damages, prejudgment and post-judgment interest, reasonable attorneys’ fees and costs and any further relief as the court deems just and proper.
