NEW ORLEANS – Three individuals
allege that the St. Charles Avenue Streetcar Line does not provide physical access to the
Mitchell Miraglia, Francis Falls and Thad Tatum filed a complaint on April 19 in the U.S. District Court for the Eastern District of Louisiana against
New Orleans City, board of commissioners of the New Orleans Regional Transit Authority and Transdev Services Inc. citing violation of the Americans with Disabilities Act.
According to the complaint, the plaintiffs allege that the defendants allegedly discriminate against persons with mobility-related disabilities, fail to provide equal access and an accessible transportation services on St. Charles Avenue and failed to bring the St. Charles Streetcar Line into compliance with the ADA requirements.
The plaintiffs request a trial by jury and seek judgment that determines that defendants are in violation of ADA, an order for defendants to make all necessary alterations to the property to make it readily accessible to and usable by individuals with disabilities, compensation for damages, reasonable attorneys’ fees, costs and expenses and such other relief as the court may deem just and proper.
