NEW ORLEANS — A boat rebuilding business is suing an insurance company and a cargo carrier, alleging their negligence damaged the plaintiff's property.

R&R Boats Inc. filed a lawsuit April 19, in the U.S. District Court for the Eastern District of Louisiana against TKO Express Corp and Progressive Express Insurance Company, alleging breach of duty in failing to train its driver to properly operate a flatbed trailer.

According to the complaint, R&R Boats purchased a spare Detroit Diesel Engine and a Twin Disk Gear, and contracted TKO to transport the equipment from Florida to Bourg, Louisiana. On April 21, 2015, the suit says, the trailer carrying the equipment overturned, and both the engine and gear were severely damaged. 

As a result, the lawsuit states, R&R suffered property damages of $51,600. 

The plaintiff alleges Progressive refused to adequately compensate R&R for damages. and that TKO's driver/agent negligently operated the flatbed trailer.

R&R Boats seeks a trial by jury, an order for defendants to pay for all losses sustained, interest, costs and disbursements. It is represented by attorneys Mark G. Tauzier, Anthony V. Lanasa Jr. and Jon M. Yeager of Yeager Lanasa Tauzier LLC in Metairie.
