Contractor, insurer files suit against NOHSC Harvey No. 1 over alleged injuries

GRETNA – Kent Construction Inc. and Amerisure Insurance Co. are suing a Jefferson Parish business following an incident in which an employee allegedly fell into a hole while installing a walk-in freezer, resulting in injuries.

Kent Construction Inc. and Amerisure Insurance Co. filed suit against NOHSC Harvey No. 1 LLC in the 24th Judicial District Court on April 18.

According to the claim, Arthur Arnold was employed by NOHSC Harvey during the time of the incident. On Jan. 3, 2011, the suit states that while working on a project to renovate an oil change facility to a restaurant, Arnold was assigned the task of installing a walk-in freezer. While working on the task, the suit states that Arnold fell into a hole on the site and sustained personal injuries, causing him to seek damages against Kent, the project's contractor, and Amerisure for their alleged involvement in the incident. Kent and Amerisure are suing NOHSC for its alleged fault in the incident, as Arnold was an employee of NOHSC and the injury occurred while he was completing work outside of his scope.

The defendants are accused of failure to maintain safe conditions on-site and failure to provide a safe workplace for employees.

Kent and Amerisure are seeking an unspecified amount in damages. They are represented by James A. Prather, Mark E. Seamster, Charles G. Clayton, Michael D. Lonegrass and Blake W. Bourgeois of Gallway, Johnson, Tompkins, Burr and Smith in Mandeville. The case has been assigned to Division I Judge Nancy A. Miller.
