NEW ORLEANS — A Louisiana vessel docking provider is suing a vessel operator and charterer, alleging non-payment of obligation.

Bollinger Fourchon LLC filed a lawsuit April 22 in U.S. District Court for the Eastern District of Louisiana against M/V Siem Spearfish, Harkand Gulf Services LLC and Harkand Group alleging the vessel operator and charterer failed to pay its indebtedness of nearly $60,000.

According to the complaint, Harkand provided docking to M/V Siem Spearfish, necessary for the operation and the accomplishment of its business. The suit says the defendants incurred charges for three docking services rendered in the collective principal amount of $59,666.76. 

Despite amicable demand from Bollinger, no payment has been received, the lawsuit states. 

The plaintiff alleges the defendants failed and refused to pay incurred charges for docking, vessel loading and unloading services, trash disposal services and other vessel necessities.

Bollinger Fourchon seeks a trial by jury, a warrant for the arrest of the M/V Siem Spearfish, judgment against Harkand for $59,666.76 plus interest, legal costs, attorney fees and all such other sums to which plaintiff is entitled. It is represented by attorneys William J. Riviere and David I. Clay II of Phelps Dunbar LLP in New Orleans.
