GRETNA – A Metairie property owner is seeking damages following an incident in which a tenant allegedly failed to follow rules and restrictions outlined in the lease.
Bich-Dao Do Le filed a suit against Kimberley Marlen-Eugene in the 24th Judicial District Court on April 11.
According to the claim, the plaintiff is the owner of a commercial space located at 3021 David Drive in Metairie and leased said property to Marlen-Eugene beginning in December 2011. Although the lease required that the defendant use the property solely for her hair and salon services, she allegedly used the property also for the sale of food and drinks. Additionally, the suit states that the defendant leased the back room of the property to another business, which was against the rules of the lease. In June 2014, the defendant allegedly stopped sending payments for the lease and was finally evicted from the premises in January 2015 after purportedly failing to make six months of payments. Upon her eviction, the property was inspected and allegedly found to be in an unacceptable condition with damaged components.
The defendant is accused of fraudulent and illegal activities, negligence, intentional malice and tortious actions.
The plaintiff is seeking compensatory and punitive damages and is represented by Blake E. Oakes. The case has been assigned to Division P Judge Lee V. Faulkner Jr.
