LAFAYETTE – A Washington state woman alleges she was injured by a prescription diabetes medication.
Linda Smith filed a complaint on April 28 in the U.S. District Court for the Western District of Louisiana against Takeda Pharmaceuticals U.S.A Inc., Takeda Global Research & Development Center Inc., Takeda Pharmaceutical Co. LTD, Takeda Pharmaceuticals America Inc., Takeda California Inc., Takeda Pharmaceuticals International Inc. and Eli Lilly and Co., citing negligence, strict products liability and other counts.
According to the complaint, the plaintiff alleges that between January 2011 and December 2011, she ingested Actos, a medication for Type II diabetes mellitus. As a direct result, she alleges she has been permanently and severely injured and was diagnosed with bladder cancer in or around June 2013. As a direct and proximate result, she claims she has also suffered mental and physical pain and suffering and has and will sustain permanent injuries and emotional distress, along with medical and living related expenses.
The plaintiff holds the defendants responsible because the defendants allegedly designed, manufactured, marketed, advertised, distributed, promoted and sold Actos and concealed and continue to conceal their knowledge that Actos’ unreasonably dangerous risks from consumers and the medical community.
The plaintiff requests a trial by jury and seeks compensation for all damages plus interest, prejudgment and post-judgment interest, costs of suit, attorney's fees and all such other and further relief as the court may deem proper.
