Disabled worker accuses former employers of wrongful termination

LAFAYETTE — A disabled employee is suing three companies, alleging he was fired because of his disability.

Jimmy W. Hammack filed a lawsuit April 27 in U.S. District Court for the Western District of Louisiana against Cetco Energy Services Company LLC, Amcol International Corporation and Mineral Technologies Inc., alleging they violated the Americans with Disabilities Act.

According to the complaint, on Aug. 24, 2013, Hammack's request to take a specific drug to combat major depression and an anxiety disorder was refused and he was fired by a human services manager for violating Cetco's discriminatory prescription drug policy. 

After Hammack filed discriminatory charges, he was rehired Dec. 1, 2013. However, the lawsuit states, he was subjected to unfair and arbitrary treatment in response to his complaint of discrimination, causing him to suffer mental anguish, and resulting in his constructive discharge Aug. 28, 2014. 

The plaintiff alleges the defendants unlawfully discriminated and/or retaliated against him and failed to follow its own policies and procedures intended to protect Hammack under the circumstances.

Hammack seeks a trial by jury, a declaration the defendants' practices violate ADA, compensation for all damages, attorney fees, legal costs and expenses, and all other relief to which he may be entitled by law. He is represented by attorneys Matthew D. McConnell and Matthew R. Reed of McConnell Law Offices in Lafayette.
