LAFAYETTE – A man alleges he was injured while shopping at the Lafayette Walmart location.

Eric Watters filed a complaint on April 27 in the U.S. District Court for the Western District of Louisiana Lafayette-Opelousas Division against Wal-Mart Louisiana LLC and Wal-Mart Stores Inc., alleging that they failed to keep their premises in a reasonably safe condition.

According to the complaint, the plaintiff alleges that while he was attempting to retrieve groceries located in a center floor cooler on a main isle on May 3, he was tripped by the hidden floor mount below the railing, causing him to lose his balance. The suit states that in an attempt to keep from falling, he reached out with his left hand and grabbed the top of the floor cooler, which resulted in serious injuries to his left arm that required surgery. The plaintiff holds Wal-Mart Louisiana LLC and Wal-Mart Stores Inc. responsible because the defendants' employees allegedly created the unreasonably dangerous conditions; failed to keep the aisles, passageways and floors in a reasonably safe condition and failed to exercise reasonable care to remove the danger.

The plaintiff requests a trial by jury and seeks compensation for all damages, general, special and exemplary, plus interest, all costs of these proceedings and for all other general, equitable and specific relief, to which he is entitled.
