Xarelto caused injures, Illinois man claims

NEW ORLEANS – An Illinois man has filed suit against several pharmaceutical companies alleging he was injured by a prescription drug.

Austin Foster filed a complaint on April 13 in the U.S. District Court for the Eastern District of Louisiana against Janssen Research & Development LLC, Janssen Ortho LLC, Janssen Pharmaceuticals Inc., Bayer Healthcare Pharmaceuticals Inc., Bayer Pharma AG, Johnson & Johnson, Bayer Corp., Bayer Healthcare LLC, Bayer Healthcare AG, Bayer AG alleging that they violated the Consumer Protection Law.

According to the complaint, the plaintiff alleges that on April 2014, he started using Xarelto. On Sept. 19, 2014, he was admitted to the hospital for treatment of gastrointestinal bleeding, the suit states. As a direct and proximate result of using Xarelto, he alleges he has suffered serious and dangerous side effects as well as severe and personal injuries which are permanent and lasting in nature. He also claims he suffered physical pain and mental anguish, diminished enjoyment of life, hospitalization and medical expenses.

The plaintiff holds the defendants responsible because the defendants allegedly designed, researched, manufactured, tested, advertised, promoted, marketed, distributed and sold Xarelto; failed to properly investigate, research, study and define the safety profile of the drug; failed to adequately test it; failed to provide adequate warnings; failed to disclose the need for dose adjustments;  and failed to provide adequate instructions.

The plaintiff requests a trial by jury and seeks compensation for damages in excess of the jurisdictional amount, economic and exemplary damages, prejudgment and post-judgment interest, reasonable attorneys’ fees and costs and such other and further relief as the court may deem just and proper.
