Woman alleges she slipped and fell in parking lot, causing injuries

GRETNA – A couple is seeking damages following an incident in which the wife was allegedly caused to fall due to a slippery portion of pavement.

Debra McIntyre and Edmond McIntyre filed a suit against EMSCO Pavement Maintenance & Supply Inc. and Continental Casualty Insurance Co. in the 24th Judicial District Court on April 21.

According to the claim, Debra McIntyre was exiting the strip mall at the corner of West Esplanade and Transcontinental on June 12, 2015, and walking across the parking lot when the incident occurred. While walking to her car across the parking lot, the plaintiff is alleged to have encountered a portion of pavement which was allegedly incredibly slippery. Upon stepping on the substance which was used in the resurfacing of the parking lot, the plaintiff was purportedly caused to slip and fall, causing her personal injuries.

The defendants are accused of negligence in its failure to warn pedestrians of the danger of the pavement, failure to properly mark the pavement and failure to prevent access to the dangerous portion of pavement.

The plaintiffs are seeking an unspecified amount in damages. They are represented by Brian D. Katz of Herman Herman and Katz LLC in New Orleans. The case has been assigned to Division I Judge Nancy A. Miller.
