NEW ORLEANS — A Louisiana couple is suing a Baton Rouge car dealership, alleging breach of warranty and negligent repair.

Mark A. Louviere and Fallon M. Louviere filed a lawsuit May 2 in U.S. District Court for the Eastern District of Louisiana against Forest River Inc. and Berryland Motors LLC of Baton Rouge, alleging violation of the Magnuson-Moss Warranty Act.

According to the complaint, on March 7, 2015, the Louvieres purchased a new 2015 Sierra 330RLS for more than $70,000, including finance charges, from Berryland. When delivered, the suit says, the Sierra was defective in materials and workmanship, with the defects being discovered within the warranty periods. 

The complaint states the defects substantially impaired the Sierra's use, value and safety. The plaintiffs allege the defendants failed to repair the vehicle to bring it into conformity with the warranties and that the attempted repairs were done so negligently, carelessly and recklessly as to substantially impair the vehicle's use, value and safety in its operation and use.

The Louvieres seek a trial by jury, an order rescinding the sale of the Sierra, compensation for all damages, economic losses, prejudgment and post-judgment interest, attorney fees, legal costs and all other relief the court deems appropriate. They are represented by attorney Richard C. Dalton of Mandeville.
