Duferco Steel Inc. seeks judgment for allegedly damaged cargo

NEW ORLEANS – A cargo owner alleges its property was damaged during shipping.

Duferco Steel Inc. filed a complaint on May 2 in the U.S. District Court for the Eastern District of Louisiana, New Orleans Division against the vessel Atlantic Daisy, Helmstar Shipping SA and Nissen Kaiun Co. LTD alleging that they allegedly failed to perform their duties and obligations.

According to the complaint, the plaintiff alleges that it suffered damages in excess of $22,420.92 for which demand has been made but not paid. The plaintiff holds the vessel Atlantic Daisy, Helmstar Shipping SA and Nissen Kaiun Co. LTD responsible because the defendants allegedly delivered the plaintiff's cargo in non-conforming and contaminated condition, misdelivered and nondelivered due to the fault, neglect, deviation, unseaworthiness, maritime tort and conversion of the defendants.

The plaintiff requests a trial by jury and seeks judgment be entered in its favor in an amount exceeding $22,420.92 plus interest, costs of this action and such other and further relief which is just and proper.
