Portable cooler manufacturer accuses competitor of unfair trade practices

NEW ORLEANS — A Louisiana portable cooler manufacturer is suing a Mississippi competitor, alleging unfair competition and/or unfair or deceptive act or practices and unjust enrichment.

Extreme Cold LLC of Covington filed a lawsuit May 3 in U.S. District Court for the Eastern District of Louisiana against Tripletail Coolers LLC of Bay St. Louis, Mississippi, alleging violation of the Unfair Trade Practices Act.

According to the complaint, on March 27, 2016, Extreme Cold discovered Tripletail was selling products manufactured by Kangjieboa, using the molds the plaintiff designed and purchased for the sole and exclusive manufacture of its own KYSEK brand coolers. 

The plaintiff alleges the defendant advertised and/or offered the re-branded KYSEK product for sale and refused to cease the sale of products that were manufactured using the molds Extreme Cold designed and purchased for the sole and exclusive manufacture of KYSEK brand coolers.

Extreme Cold seeks a trial by jury, compensation for all damages, attorney fees, legal costs and all other relief the court deems proper. It is represented by attorneys Michael W. Rutledge and David P. Salley of Salley Hite Mercer & Resor in New Orleans.
