NEW ORLEANS — A Florida man is suing a group of pharmaceutical firms, alleging negligence in the manufacturing and sale of the drug Xarelto.

Gregory Dunn of Miami filed a lawsuit May 4 in U.S. District Court for the Eastern District of Louisiana against Janssen Research & Development LLC, Janssen Ortho LLC, Janssen Pharmaceuticals Inc., Bayer Healthcare Pharmaceuticals Inc., Bayer Pharma AG, Bayer Corporation, Bayer Healthcare LLC, Bayer Healthcare AG and Bayer AG, alleging they violated the Consumer Protection Law, failure to warn, breach of warranty and negligent misrepresentation.

According to the complaint, Dunn used Xarelto July 23, 2013, through Aug. 29, 2014. As a direct and proximate result of the use of Xarelto, the suit says, he experienced gastrointestinal bleeding Sept. 5, 2014, and suffered a life-threatening, irreversible bleeding, as well as severe pain and suffering, which are permanent and lasting in nature. 

The plaintiff alleges the defendants, who designed, researched, manufactured, tested, advertised, promoted, marketed, distributed and sold Xarelto, failed to properly investigate, research, study and define the safety profile of the drug, failed to adequately test it or provide adequate warnings, failed to disclose the need for dose adjustments and failed to provide adequate instructions.

Dunn seeks trial by jury and seeks compensatory damages in excess of the jurisdictional amount, an award for economic damages, prejudgment and post-judgment interest, attorney fees, costs and any other relief the court deems proper.
