Woman alleges Ochsner Hospital failed to properly treat leg

GRETNA – A St. Tammany Parish woman is seeking damages following an incident in which a hospital allegedly failed to correct her injured leg.

Shelly N. Benjamin filed a suit against Ochsner Hospital in the 24th Judicial District Court on May 3.

According to the claim, Benjamin's leg was injured in a car accident on Nov. 30, 2012, and was transferred to Ochsner Hospital for treatment. The suit states that after receiving treatment from the hospital, Benjamin waited three weeks and sought out a second opinion about her leg. The doctor at Tulane Hospital who examined her purportedly informed her that her hip had been dislocated and that this had been overlooked by the defendant. The suit also states that due to the fault of the defendant, the plaintiff has lost the ability to work.

The defendant is accused of negligence in its failure to treat the patient properly and restore her leg to its proper condition.

The plaintiff is seeking an unspecified amount in damages. She is represented by J. Michael Daly Jr. of Walker Daly in Metairie. The case has been assigned to Division P Judge Lee V. Faulkner Jr.
