Man claims that a truck fell on his foot, causing him injury

GRETNA – An Orleans Parish man seeks damages following an incident in which he claims that his foot was injured by a falling truck.

Rico Lee filed a suit against Pull-A-Part of New Orleans West LLC and XYZ Insurance Co. in the 24th Judicial District Court on April 27.

According to the claim, the plaintiff was a customer of Pull-A-Part at 4401 Peters Road in Harvey on Aug. 13, 2015, when the incident occurred. The suit states that while the plaintiff was taking off a component that he wanted to purchase from the back of the truck, the truck fell from the propped-up position it was in and fell on the plaintiff's foot.

The defendant is accused of negligence, gross and flagrant carelessness through its failure to exercise a reasonable amount of care, failing to train employees sufficiently and failing to maintain the premises in a safe and danger-free condition.

The plaintiff is seeking an unspecified amount in damages. He is represented by Pius A. Obioha, Kelly S. Love and Lamarret T. Elder of the Law Offices of Pius A. Obioha and Associates LLC in New Orleans. The case has been assigned to Division M Judge Henry G. Sullivan Jr.
