Train passenger blames multiple entities for injuries

NEW ORLEANS — A Louisiana train passenger is suing multiple entities, alleging their negligence caused her to be injured. 

Naisy Richards of Metairie filed a lawsuit May 5 in U.S. District Court for the Eastern District of Louisiana against KCJ’s Trucking LLC, State National Insurance Company, Amite City, Tangipahoa Parish, Amtrak and Illinois Central Railroad Company, alleging their negligence failed to keep a crossing and the surrounding areas in good, safe and well-maintained condition.

According to the complaint, on May 10, 2015, Richards was injured when the passenger train she was riding in struck a KCJ’s Trucking vehicle at a crossing in Amitie. The plaintiff alleges the failed to install lights, audible warnings, or crossing arms. 

The suit says KCJ'S Trucking's driver entered the crossing without yielding to the train, failed to maintain reasonable and proper control of the vehicle, operated the vehicle in a reckless and negligent manner and failed to keep proper lookout.

The suit says the plaintiff suffered injuries to her neck, back, hips and extremities. 

Richards seeks a trial by jury, all damages plus legal interest, all legal costs and all equitable relief the court deems appropriate. She is represented by attorney Matthew D. Hemmer of Morris Bart LLC in New Orleans.
