State chartered bank alleges guarantor owes more than $2 million

NEW ORLEANS — An state chartered bank is suing a New Jersey guarantor, alleging default in payment of more than $2 million.

First NBC Bank filed a lawsuit May 6 in U.S. District Court for the Eastern District of Louisiana against Fred Kirsch of Ocean, New Jersey, alleging breach of contract in that the guarantor failed to comply with the promissory note and commercial guaranty.

According to the complaint, First NBC Bank has suffered damages of $2,363,896.28 because Kirsch unconditionally guaranteed repayment of all indebtedness owed by the borrowers and failed to make any payment when due.

First NBC Bank seeks a trial by jury, judgment for all amounts due, including but not limited to $2,363,896.28 in principal, $31,933.15 in property taxes, $40,996.20 in forced placed insurance and $32,402.32 in accrued interest.
