NEW ORLEANS – A construction worker has filed a class-action lawsuit against his employers alleging employees were not paid overtime wages.
Bismark Mairena-Rivera filed a complaint on behalf of other persons similarly situated on May 9 in the U.S. District Court for the Eastern District of Louisiana against
Langston Construction LLC, Composite Architectural Design Systems LLC and Michael Langston,
alleging that they allegedly violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he was not paid one-and-a-half times of his regular hourly rate for all hours worked in excess of 40 hours per work week. The plaintiff holds Langston Construction LLC, Composite Architectural Design Systems LLC and Langston responsible because the defendants allegedly treated him as exempt from the FLSA’s overtime requirements and failed and refused to pay proper overtime compensation.
The plaintiff requests a trial by jury and seeks declaration that defendants’ conduct violated the FLSA, compensation for unpaid overtime wages, plus an additional amount in liquidated damages, attorneys’ fees and costs, prejudgment and post-judgment interest and such other general and equitable relief as the court deems equitable and just. He is represented by Roberto Luis Costales and Emily A. Westermeier of Costales Law Office in New Orleans and William H. Beaumont of William H. Beaumont Law in New Orleans.
